What is the DePuy Hip Implant?
The DePuy Hip Implant, known as the ASR XL Acetabular implant, is a hip replacement device that was manufactured and sold by DePuy Orthopedics from 2005 until 2009. The DePuy Hip Implant was marketed to more active patients as a more durable, longer lasting option because of its unique metal-on-metal ball and socket design.
The DePuy Hip was approved by the FDA in August of 2005 and released soon after. Although it was sold to over 93,000 patients, doctors soon began reporting significant problems with the device indicating implant failure.
In 2007, approximately 100 reports were made to the FDA of severe side effects. By 2008 there were over 200 reports and by 2009, more than 300 reports were made of side effects of such significance that doctors believed surgery would be required to remove the device.
Experts believe that more than 13% of patients who received a DePuy Hip Implant so far have needed a revision surgery and thousands more will need to have their device replaced. This is markedly higher than the standard failure rate for implants.
DePuy suspended sales of the ASR Hip Implant in late 2009, then warned surgeons of early failure rates and removed all remaining implants on the market from inventory in March of 2010. On August 26, 2010, DePuy issued a recall of all ASR XL Acetabular Implants.

Who makes the DePuy Hip Implant?
The DePuy ASR XL Hip Implant was made by DePuy Orthopaedics, Inc., a wholly owned subsidiary of healthcare giant Johnson & Johnson. Johnson & Johnson is the largest producer of health-related products in the world with revenue of $61.9 billion in 2009 alone.
DePuy Manufacturing was originally founded in 1895 in Warsaw, Indiana by Revra DePuy. The company started by designing and manufacturing fiber splints that were used to set bone fractures.
DePuy was purchased by Johnson & Johnson in 1998 and came to be organized under the Johnson & Johnson Medical Devices & Diagnostics group. The subsidiary now develops and manufactures medical products under the brand names DePuy Mitek, DePuy Orthopaedics, Codman and DePuy Spine.
DePuy now operates from many different countries besides the United States, including France, Germany, Japan, Ireland, Australia and the United Kingdom.
The company manufactures approximately one-third of all hip implant devices used in hip replacement surgeries in the United States. The ASR XL Hip Implant was used in more than 93,000 patients between 2005 and 2010, generating approximately $5.4 billion in revenue from 2009 alone.

What should I do about my DePuy Hip Recall?
If you received a DePuy Hip Implant after 2004, you should speak with an attorney before doing anything regarding the recall.
As part of the recall, DePuy has indicated it will pay “reasonable and customary costs of monitoring and treatment” for the defective hip implants. This may include surgical costs to replace the device, however, it does not compensate patients for pain and suffering, lost time or wages, or the risk of undergoing another surgery.
DePuy is also asking patients to sign a medical release and turn over the faulty hip implant device if it is removed. This could significantly limit your legal rights.
Do not sign anything from DePuy or Johnson & Johnson without first speaking with an Attorney. We are available 24 hours a day to answer your questions and provide a confidential evaluation of your case.
When was the DePuy Hip Implant approved by the FDA?
The DePuy ASR XL Hip Implant was submitted to the FDA for approval in March of 2004 and approved for use in August of 2005. DePuy used a less-stringent approval process known as the 510(k) process, which uses comparisons to current products rather than the traditional and more difficult pre-market approval process.
Serious problems began to surface with the DePuy Hip Implants soon after their introduction. In 2007, approximately 100 patients reported problems. That number jumped to more than 200 in 2008 and 300 in 2009.
The DePuy Hip Implant was used in more than 93,000 patients from 2005 until 2010. On August 26, 2010, DePuy issued a recall of the ASR XL implant, a decision that has been classified as an official recall by the FDA.

What are the Side Effects of the DePuy Hip Implant?
Defective DePuy Hip Implants can produce drastic side effects such as loosening or detachment of the implant from bone, dislocation of the implant, fracture of the bone around the implant, metal shavings from excessive metal-on-metal wear, metallic poisoning, bone loss and the need for revision surgery.
These side effects can result in disabling symptoms including pain in the thigh, hip or groin, pain while walking or standing, inflammation, vision loss, muscle damage, hearing loss, and extensive soft tissue damage.
Under normal standards, no more than 5% of hip implants should fail or need revision surgery within 5 years. With the DePuy Hip Implant, however, more than 13% of patients so far have needed surgery to remove faulty devices.

What are the symptoms of a defective DePuy Hip Implant?
As part of the recall issued by DePuy Orthopedics for the ASR XL Implant, the company has advised patients to see their doctor to check for certain symptoms which may indicate hip implant failure.
A defective Hip Implant device can cause significant symptoms such as:
- pain in the thigh
- hip pain
- groin pain
- pain while walking or standing
- difficulty walking or standing
- vision or hearing loss, and
- tumors.

How long do I have to file a DePuy lawsuit?
The time to file a lawsuit for injuries from defective DePuy Hip Implants is limited, though it is different from state to state. Lawsuits in the United States are subject to a Statute of Limitation, or time limit, which, after expired, will prevent an injured person from filing a case.

The Statute of Limitation for DePuy Lawsuits may begin to expire when you are notified of the DePuy Hip Implant recall. Therefore, it is important to speak with an attorney immediately to find out how much time you have to file a claim.
Even if your lawsuit has not expired, it is important to contact a DePuy Attorney prior to the date your Statute of Limitations expires. If you wait to contact an attorney until a week or month before your case expires, they may not have proper time to research your case and prepare it for filing.
