DePuy Orthopedics has issued a full recall of its ASR XL Acetabular hip implant and advised patients who received the implant to consult with their hip surgeon to evaluate for symptoms of DePuy Hip Side Effects which may signify hip implant failure.
Defective DePuy Hip Implants can yield dramatic side effects such as loosening or detachment of the implant cup from failure of bone ingrowth, dislocation of the implant ball from the cup, fracture of the bone around the implant, metal shavings from excessive metal-on-metal wear, metallic poisoning, bone loss and the need for revision surgery.
These DePuy Hip Side Effects can result in disabling symptoms including pain in the thigh, hip or groin, pain while walking or standing, inflammation, vision loss, muscle damage, hearing loss, and extensive soft tissue damage.
Under normal standards, no more than 5% of patients who receive a certain type of hip implant should need a revision surgery due to failure within 5 years. With the DePuy Hip Implant, however, more than 13% of patients so far have needed surgery to remove faulty devices.
If you or a loved one received a DePuy Hip Implant since 2005, it is important that you speak with a DePuy Hip attorney to discuss your legal rights before making any decisions. Lawyers are currently filing DePuy Hip Lawsuits for damages related to these faulty devices. Time to file is limited.
The recalled DePuy Hip Implant was originally marketed to younger, more active patients based on the claim that its metal-on-metal ball joint was more durable and less prone to dislocation. The DePuy Hip Side Effects from these devices, however, have demonstrated much different results.
Beginning in 2007, doctors reported significant DePuy Hip Side Effects in patients returning from surgery that pointed towards implant failure. Approximately 100 reports of side effects were made in 2007, then more than 200 in 2008 and over 300 in 2009.
Increasing evidence suggests that DePuy had evidence of significant DePuy Hip Side Effects in patients in the first few years of production, but continued to market the defective product rather than warn consumers or doctors, or order a recall. The defective hip device wasn’t removed from the market entirely until early 2010.
Legal Options
As part of the recall, DePuy has indicated that it will pay “reasonable and customary costs of monitoring and treatment” related to the recalled hip implants. However, they are also asking patients to sign a medical release and turn over the faulty hip implant device if it is removed.
The recall offer by DePuy offers no compensation for patients’ pain and suffering, lost time or wages, or the risk of undergoing a revision surgery. Further, the request for medical records and the return of the device may significantly limit the future legal rights of affected patients.
The defective hip is the most important piece of evidence in any claim for DePuy Hip Side Effects damages. Rather than turning it over to the company responsible for your problem, a qualified attorney can arrange to have it tested by an independent third party for defects.
If you received a DePuy Hip Implant beginning in 2005 and have been contacted about a recall, DO NOT SIGN ANYTHING before contacting us to discuss your legal rights. Lawyers are available 24 hours a day for a free consultation of your case. Time to file a claim is limited.
