DePuy Hip Detachment / Loosening

The defective DePuy Hip Implant has been associated with side effects so significant that a large percentage of patients have required removal of the device within a few years of implantation.  One of these side effects is the loosening or detachment of the implant from the pelvic bone.

Hip replacement implants use a ball and cup mechanism, with the cup being fastened to the patient’s pelvic bone.  The adherence of this cup to the bone is vital to the stability of the implant system and relies on a healthy pelvic bone as a foundation.

The DePuy ASR Hip Implant has been plagued with loosening and detachment issues.  This can occur when the bone fails to grow or attach itself to the newly-implanted metal cup, or when metal poisoning causes bone loss, infection of soft tissue damage.

Since the DePuy Hip utilizes a metal-on-metal ball and cup system, metal shavings from extensive wear have been known to lead to such problems.  This is one of the main reasons the DePuy Hip Implant was recalled due to high failure rates.

The loosening or detachment of the cup porting of a hip implant can cause extensive pain in the thigh, hip and groin.  It can also lead to trouble walking or standing.  DePuy has advised patients who received the implant to consult with their hip surgeon to evaluate for these types of symptoms.

If you or a loved one received a DePuy Hip Implant since 2005, it is important that you consult with your doctor about possible detachment symptoms and speak with a DePuy Hip Attorney about your legal rights.  Lawyers are currently filing DePuy Hip Lawsuits for damages related to these faulty devices.

Typically, a hip implant device should not have a failure rate of more than 5%.  In the case of the DePuy Hip Implant, however, more than 13% of patients so far have needed surgery to remove the faulty devices within 5 years of the product’s release due to side effects like DePuy Hip detachment or loosening.

In 2007, doctors reported approximately 100 cases to the FDA of side effects such as DePuy Hip detachment or loosening in patients returning from surgery.  By 2008 that number was above 200 and by 2009, more than 300 complaints were filed.

Legal Options

DePuy ordered a recall of all ASR XL implants on August 26, 2010.  As part of the recall, DePuy has indicated they will pay “reasonable and customary costs of monitoring and treatment” related to the recalled hip implants.  While this may include the cost of revision surgery, it does not compensate patients for their pain and suffering, lost time or wages, or the risk of undergoing the revision surgery.

DePuy is also asking patients to sign a medical release and turn over the faulty hip implant device if it is removed.  The defective hip is the most important piece of evidence in any claim for DePuy Hip Side Effects damages and should be tested by an independent third party for defects.  Agreeing to release your medical records and return the faulty device may severely limit your future legal rights.

If you received a DePuy Hip Implant beginning in 2005 and have been contacted about a recall, DO NOT SIGN ANYTHING before contacting us to discuss your legal rights.  Lawyers are currently filing DePuy Hip Lawsuits and are available 24 hours a day for a free consultation of your case.  Time to file a claim is limited.
