DePuy Orthopedics recently issued a full recall of the ASR XL Acetabular hip implant that has been on the market since 2005. The company has advised patients who received the implant to see their surgeon to check for certain DePuy Hip Symptoms which may indicate hip implant failure.
The defective DePuy Hip Implants can cause severe side effects such as loosening or detachment of the device from the pelvic or femur bone, dislocation of the implant, fracturing of the hip or femur bone attached to the implant, metal shavings from wear of the device, muscle and soft tissue damage, metallic poisoning and bone loss.
The considerable side effects from a defective device in turn can cause significant DePuy Hip Symptoms such as:
- pain in the thigh
- hip pain
- groin pain
- pain while walking or standing
- difficulty walking or standing
- vision or hearing loss, and
- tumors.
Experts estimate that more than 13% of the patients who received DePuy Hip Implants will need surgery to remove the faulty devices. A larger number may suffer from defective DePuy Hip Symptoms for years before making the decision to have it removed.
It is important to see your doctor and monitor for symptoms of severe implant failure in order to protect yourself. Even if you have not experienced any adverse symptoms from your DePuy Hip Implant, the introduction of metal shavings from this product into your bloodstream can cause serious long term health problems.
If you or a loved one received a DePuy Hip Implant, it is important that you see your doctor and speak with a DePuy Hip attorney to discuss your legal rights. Lawyers are currently filing DePuy Hip Lawsuits for the severe side effects and symptoms related to these faulty devices. Time to file is limited.
The FDA received hundreds of reports of DePuy Hip failure between 2007 and 2009 indicating the company knew about the serious side effects of its product soon after it was released. However, they continued to market the defective product for years rather than warn consumers or order a recall.
Since DePuy did not remove the defective implant from the market until early 2010 or issue a recall until August 26, 2010, thousands of patients are suffering from DePuy Hip Symptoms who could have chosen an alternative implant device.
As part of the recall, DePuy has indicated it will pay “reasonable and customary costs of monitoring and treatment” for the recalled hip implants. While this may include the cost of surgery to replace the device, it does not compensate patients for pain and suffering, lost time or wages, or the risk of undergoing the repeat surgery.
DePuy is also asking patients to sign a medical release and turn over the faulty hip implant device if it is removed.
IT IS IMPORTANT THAT YOU NOT SIGN A RELEASE FROM DEPUY.
Agreeing to release your medical records and return the faulty device may severely limit your future legal rights.
