Hip Pain
Doctors evaluating patients who received the DePuy Hip Implant after 2005 have reported significant side effects like loosening or detachment of the device, dislocation, fracturing of bones, metal shavings, muscle and soft tissue damage, metallic poisoning and bone loss.
As a result of an increasing number of device failures, DePuy issued a recall of their ASR XL Implant on August 26, 2010. Those who received the implant are urged to consult with their doctor to check for symptoms of hip implant failure.
One of the main symptoms of a defective hip implant is persistent DePuy hip pain. Whether hip pain is mild or intense, it could be a sign of serious implant defects like detachment, loosening or dislocation of the device, bone fractures or complications from metallic poisoning.
The tiny metal shavings that can be shed from the DePuy Hip Implant have been shown to cause bone loss or damage to muscle and soft tissue. These too can cause symptoms of DePuy hip pain.
Experts estimate that more than 13% of the patients who received DePuy Hip Implants will have to undergo surgery to remove the device because of persistent symptoms like DePuy Hip Pain.
If you or a loved one received a DePuy Hip Implant and are suffering from hip pain, it is important that you see your doctor to evaluate for implant failure. You should also speak with a DePuy Hip Attorney about your legal rights before making any decisions.
Even if you have not experienced DePuy hip pain or other adverse symptoms from your implant, you could be at risk. The DePuy Hip Implant has been shown to shed tiny metal shavings from its metal ball and socket which can be absorbed into the bloodstream, causing serious long term health problems.
Legal Options
The FDA has received approximately 1,000 reports from doctors of adverse symptoms such as DePuy hip pain which may signify implant failure. Some reports indicate DePuy knew about the risks of the ASR implant soon after release, but continued to market the defective product for years before it warned consumers or ordered a recall.
As part of the August, 2010 recall, DePuy has indicated it will pay “reasonable and customary costs of monitoring and treatment” for the defective hip implants. Although this may include the cost of surgery to replace the device it does not compensate patients for pain and suffering, lost time or wages, or the risk of undergoing the repeat surgery.
If you received a DePuy Hip Implant it is important that you not sign anything from DePuy or Johnson & Johnson before discussing your legal rights with an attorney. We are available 24 hours a day to answer your questions and provide a confidential evaluation of your case.
